1. Introduction

This Acceptable Use Policy (the “Policy”) sets out the rules for using the GenSix Digital website at g6.co.za and any hosting, website, email, or related services that GenSix Digital (Pty) Ltd (“GenSix Digital”, “we”, “us”, or “our”) makes available to you.

The Policy is designed to protect our clients, our visitors, our infrastructure, our service partners, and the wider internet community. It applies alongside our Terms and Conditions and Privacy Policy. Where a signed service agreement is in place, that agreement and this Policy are read together, and the service agreement takes precedence if there is any conflict.

By visiting our website, or by using any service we provide, you agree to this Policy. If you do not accept it, please do not use the website or our services.

2. Who this Policy applies to

This Policy applies to everyone who interacts with us online, including:

  • Website visitors anyone who browses g6.co.za or submits information through our contact forms.
  • Clients businesses and individuals for whom we build, host, manage, or maintain websites, online stores, or email.
  • Authorised users staff, contractors, or agents who access a service through a client account.

If you allow other people to use a service under your account, you are responsible for making sure they follow this Policy. Their actions are treated as your own.

3. General standard of conduct

You must use our website and services lawfully, honestly, and with respect for others. In short, you may not use them in any way that is illegal, that harms or interferes with other people or systems, or that damages the reputation or operation of GenSix Digital or our service partners.

You are responsible for all activity that takes place through your account or through any website, store, or mailbox we host for you, including all content you or your users publish, store, or transmit.

4. Prohibited activities

When using the website or any service, you may not, and may not permit anyone else to:

4.1 Unlawful use

  • Break any applicable law, regulation, or industry code, including the Electronic Communications and Transactions Act, the Protection of Personal Information Act (POPIA), the Cybercrimes Act, and the Consumer Protection Act.
  • Publish, store, or share content that is unlawful, fraudulent, defamatory, or that promotes illegal activity.
  • Sell or advertise goods or services that you are not legally allowed to offer.

4.2 Harmful, abusive, or offensive content

  • Publish or transmit content that is hateful, harassing, threatening, or that incites violence or discrimination.
  • Publish or distribute any child sexual abuse material. We report such material to the authorities and remove it immediately, without notice.
  • Publish content that is obscene or that is otherwise harmful to minors.

4.3 Intellectual property

  • Copy, use, or distribute text, images, software, trademarks, or other material that you do not own or have permission to use.
  • Remove or alter any copyright, trademark, or other proprietary notice.

4.4 Privacy and personal information

  • Collect, store, or process other people’s personal information unlawfully, or in breach of POPIA.
  • Share or publish someone else’s personal or confidential information without a lawful basis and their consent where required.

4.5 Security and system integrity

  • Attempt to gain unauthorised access to any account, server, network, or data, whether ours or anyone else’s.
  • Probe, scan, or test the vulnerability of any system, or breach or circumvent any security or authentication measure.
  • Introduce or distribute viruses, malware, ransomware, or any other malicious or harmful code.
  • Interfere with or disrupt any service, server, or network, including through denial of service attacks or by overloading infrastructure.

4.6 Network and resource abuse

  • Use more server resources (processing, memory, storage, or bandwidth) than your service plan reasonably allows, in a way that degrades service for others.
  • Run activities that place an excessive or abnormal load on shared infrastructure, such as untuned scripts, crypto mining, public file dumps, or bulk automated scraping.
  • Use our services to operate an anonymising proxy, open relay, or similar service.

4.7 Spam and unsolicited communication

  • Send bulk, unsolicited, or deceptive email, messages, or comments (spam), or send any communication that breaches POPIA’s rules on direct marketing.
  • Harvest email addresses or contact details from the internet for unsolicited messaging.
  • Forge headers or otherwise disguise the origin of any message sent through our services.

The lists above are examples of prohibited use. They are not a complete list. Anything with a similar purpose or effect is also not allowed.

5. Website visitors and interactive features

If our website lets you submit a message, comment, review, or other content, you must keep it lawful, relevant, and respectful. You may not submit content that is false, misleading, abusive, or that infringes anyone’s rights.

You may not use automated tools to scrape, copy, harvest, or index the website, or attempt to interfere with how it works, without our written permission. We may remove any submitted content and restrict access at our discretion.

6. Hosting and hosted services

The following applies where we host a website, online store, mailbox, or other service for you.

  • Responsibility for content You are responsible for everything published or stored on your hosted service, including content added by your staff, developers, or customers.
  • Keeping software current Where you manage your own site, you are responsible for keeping themes, plugins, and applications updated and secure. A neglected, outdated, or compromised installation that threatens other clients may be suspended until it is resolved.
  • Backups You are responsible for keeping your own backups of your data, unless a care plan or support agreement with us states otherwise. We are not liable for loss of data.
  • Fair use of resources Shared hosting resources are provided on a fair use basis. If your usage harms performance or stability for others, we may ask you to optimise, move to a larger plan, or reduce usage.
  • Lawful commerce Any online store you operate must sell only lawful goods and services, display accurate pricing and terms, and comply with the Consumer Protection Act and applicable payment rules.

7. Email and anti-spam

Email services we provide are for legitimate business and personal use. You may not use them to send spam or unlawful direct marketing, to send messages with forged or misleading headers, or in any way that could cause our mail servers or shared IP addresses to be blacklisted.

If your email activity harms the deliverability or reputation of shared infrastructure, we may suspend the affected mailbox or account to protect other clients.

8. Third-party providers

Some of our services rely on trusted third-party providers, including our hosting partner (Xneelo) and payment partner (Peach Payments). When you use a service that depends on a third party, you also agree to that provider’s acceptable use and service terms. We are not responsible for the acts, omissions, or availability of third-party providers, although we will act reasonably to assist you where we can.

9. Your security responsibilities

  • Keep your login details, passwords, and access keys confidential and secure.
  • Tell us promptly if you suspect any unauthorised access to or misuse of your account.
  • Make sure anyone you give access to understands and follows this Policy.

You remain responsible for all activity carried out through your account, whether or not you authorised it.

10. Monitoring, enforcement, and takedown

We do not routinely monitor the content of hosted services, but we may review activity where we reasonably believe this Policy has been breached, where we are required to by law, or where it is necessary to protect our systems, our clients, or the public.

If we believe a breach has occurred, we may, depending on how serious it is and without being obliged to give prior notice:

  • Ask you to correct the problem within a set time.
  • Remove, disable, or restrict access to the content or activity concerned.
  • Suspend or throttle the affected service.
  • Suspend or terminate your account or service agreement.
  • Report the matter to the relevant authorities and cooperate with any investigation.

Where the risk to other clients or to our infrastructure is immediate, such as a security compromise, active attack, or unlawful content, we may act first and notify you afterwards. We will act reasonably and, wherever practical, give you the chance to put things right. We are not liable for any loss you suffer as a result of action we take in good faith under this Policy.

11. Reporting a breach or abuse

If you believe that content or activity on our website or on a service we host breaches this Policy or infringes your rights, please report it to us at info@g6.co.za with enough detail for us to identify and investigate the matter. We take all genuine reports seriously and will respond as quickly as we reasonably can.

12. Changes to this Policy

We may update this Policy from time to time to reflect changes in our services, technology, or the law. The current version is always the one published on our website, and it applies from the date it is posted. Please check back from time to time. Continuing to use the website or our services after a change means you accept the updated Policy.

13. Governing law and contact

This Policy is governed by the laws of the Republic of South Africa, and any dispute relating to it is subject to the jurisdiction of the South African courts.
